TMH takes its responsibilities in relation to protection Personal Data and compliance with the applicable laws very seriously. TMH is committed to properly manage, protect and process your Personal Data in accordance to this Privacy Policy, which shall apply to all Personal Data collected from you through TMH Website and E-Bidding Platform. The definitions used in the Online Auction Agreement is incorporated herein as a reference. The term you, your and yours are references to anyone accessing, browsing and using the TMH Website and all E-Bidder.

In this Privacy Policy, “Personal Data” shall mean any data, whether true or untrue, which is (a) about an individual who can be identified (i) from that data; or (ii) from that data and other information to which TMH have or are likely to have access and would include data in TMH’s records as may be updated from time to time, or (b) defined as “personal data” or “personal information” under the applicable data protection laws in Malaysia.

Please read and review this Privacy Policy, which will inform you how TMH collects, stores, uses and discloses your Personal Data. TMH may also collect and process Personal Data under any exceptions to the applicable laws, which may not be set out in this Privacy Policy.

TMH may update this Privacy Policy from time to time to ensure that it is consistent with industry trends and/or any changes in legal or regulatory requirements. You agree to be bound by the prevailing terms of this Privacy Policy as updated from time to time.

Information TMH Collects

TMH collects Personal Data from you. Personal Data may include your name, contact details, mailing address, physical address, business address, registered address, birthday, network and device data (including your IP address and device or advertising identifiers), your browsing behaviors, facial image, voice recording and any other personally identifiable information which you have provided to us in any forms you may have submitted to us, in the course of any other forms of interaction between you and TMH. If you provide TMH with Personal Data relating to a third party by submitting such Personal Data to us, you represent to TMH that you have obtained the consent of the third party to provide us with their Personal Data for the respective purpose.

By (a) clicking “I agree” or “yes” or clicking on the section provided on our Privacy Policy pop-up or any web form referring to this Privacy Policy on TMH Website, (b) submitting your Personal Data to TMH when registering for an E-Bidder Account on the TMH Website, (c) browsing the TMH Website, or (d) participating in the auction through the E-Bidding Platform, you are agreeing to the terms of this Privacy Policy.

How TMH Collects Personal Data

TMH collects Personal Data from you when (a) you register an account on the TMH Website; (b) you participate as an E-Bidder through the E-Bidding Platform; (c) you browse the TMH Website; (d) you accept our cookies on your device; (e) you interact with TMH or other representatives of TMH, for example, via the TMH Website, emails, telephone calls, letters or face-to-face meetings; (f) your authorized representative submits your Personal Data to TMH for any purpose reasonably authorized by you, for example, bidding on your behalf; (g) our third-party analytics and other service providers provide your Personal Data to us, which was collected and processed by them and disclosed to us pursuant to their separate privacy policy; or (h) you voluntarily submit your Personal Data to us for any reason.

TMH may collect your bank information details to process payment and refund of your Deposit Sum and Buyer’s Premium. TMH may collect your Personal Data in circumstances where such collection does not require consent under Applicable Laws.

Please ensure that all Personal Data submitted to us are complete, accurate, true and correct. Failure to do so may result in our inability to communicate with you.

Who Will Your Personal Data be Shared with

In relation to TMH’s use to the Personal Data, TMH may disclose the Personal Data to (a) employees, consultants, Legal Owner or their agents; (b) payment processors, who process your payment; (c) related companies or subsidiary companies of TMH; (d) professional advisors and consultants; (e) agents, contractors or service providers who provide operational services to TMH, such as online cloud storage and processing, marketing optimization, information technology, telecommunication, security or other relevant services which requires their collection, use or disclosure of the Personal Data; (f) any other party whom you authorize to disclose the Personal Data to;

TMH may also disclose Personal Data (a) for other purposes which are reasonably related and anticipated from use of the TMH Website and where TMH has obtained and maintained related consent, or (b) in circumstances where such disclosure does not require consent under the applicable laws.

You acknowledge and agree that TMH has the right to disclose Personal Data to any legal, regulatory, governmental, tax, law enforcement or other authorities if TMH has reasonable grounds to believe that the disclosure is necessary for meeting the obligations, requirements or arrangements as a results of complying or cooperating with an order, investigation and/or request of any nature by such parties.

Third Party Cookies

TMH may use services of third-party vendors, who may implement cookies on the TMH Website. Advertisements on the TMH Website may be provided by third party agents. These advertisements may also generate cookies, for example, to track how many people have viewed the advertisement. The collection, use and disclosure of information, including Personal Data, collected by such third-party cookies are subject to the privacy and data protection policies of third party vendors and are not under TMH’s control.

You may reject third party cookies through the settings on your browser. Note that this may result in the loss of website functionality, restrict your use of the TMH Website or EBidding Platform, or delay or affect the way in which the TMH Website operates.

How TMH Protects Personal Data

TMH may implement security measures designed to protect your Personal Data from unauthorized access. Your account is protected by your account password and TMH urge you to take steps to keep your Personal Data safe by not disclosing your password and by logging out of your account after each use. TMH further protect your Personal Data from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your Personal Data will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using the TMH Website, you acknowledge that you understand and agree to assume these risks.

Links to Other Websites

TMH may provide links to or compatibility with other websites or applications. However, TMH are not responsible for privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to Personal Data collected by us through TMH Website and the E-Bidding Platform. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link on TMH Website. To the extent that you access or use the TMH Website through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. TMH encourages you to read the privacy statements of other websites before proceeding to use them.
